AGREEMENT BETWEEN THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM AND THE GOVERNMENT OF MONGOLIA ON THE EXEMPTION OF VISA REQUIREMENTS FOR HOLDERS OF DIPLOMATIC, OFFICIAL, ORDINARY PASSPORTS

The Government of the Socialist Republic of Viet Nam and the Government of Mongolia, hereinafter referred to as the “Contracting Parties”,

Being guided by the desire to develop further existing friendly relations between the two States,

Desiring to promote, facilitate and encourage exchange of visits of people of the Contracting Parties by the exemption of visa requirements for holders of their valid passports;

Have agreed as follows:

Article 1

1. Citizens of one Contracting Party, who are holders of valid diplomatic or official passports with a minimum validity of six (6) months, shall be exempt from visa requirement for entry into, exit from and transit through the territory of the other Contracting Party and the duration of stay does not exceed 90 (ninety) days from the date of entering. This duration may be extended, for the reasons of force majeure, upon the request in writing of the diplomatic mission or consular post of the Contracting Party whose citizens the passport holders are.

2. The passport holders referred to in paragraph 1 of this Article, who intend to stay more than 90 (ninety) days in the territory of the other Contracting Party, are required to obtain visas in advance.

3. The visas mentioned in paragraph 2 of this Article shall be issued on mutual gratis basis.

Article 2

1. Citizens of one Contracting Party, who are members of the diplomatic mission or consular post of his or her country accredited in, or representatives of his or her country to the international organization located in the territory of the other Contracting Party, holding valid diplomatic or official passports. shall be exempt from visa requirement for entry into and exit from the latter’s territory, as well as be permitted to stay there during the period of their assignment.

2. The same privileges shall also be applied to the spouse and children of the persons mentioned in paragraph 1 of this Article, provided that they are holders of diplomatic or official passports or the children’s names are entered in their father’s or mother’s passport.

Article 3

1. Citizens of one Contracting Party holding valid ordinary passports with a minimum validity of six (6) months, may enter into, exit from, transit through and stay in the territory of the country of the other Contracting Party without visa for a maximum period of up to 30 (thirty) days, under the condition that the purpose of the visit is not-for-profit activities.

2. The citizens of either Contracting Party holding valid ordinary passports, traveling to the other Contracting Party, with the intention of stay in such territory beyond the period provided for in paragraph I of this Article, are required to obtain visas in advance.

Article 4

Nationals of either Contracting Party holding valid diplomatic, official and ordinary passports of either Contracting Party shall enter into, exit from or transit through ports open to international travelers of the other Contracting Party and go through necessary formalities in accordance with the laws and regulations of that Contracting Party.

Article 5

Nationals of either Contracting Party holding valid diplomatic, official and ordinary passports of either Contracting Party shall abide by the laws and regulations of the other Contracting Party during their stay in that Contracting Party.

Article 6

This Agrcement does not restrict the right of the competent authorities of either Contracting Party to prohibit passport holders of the other Contracting Party who are considered undesirable from entering into or shorten or terminate their stay in its territory.

Article 7

Each Contracting Party may, for the reason of ensuring national security. public order or public health, suspend this Agreement, either in whole or in part.
The introduction and termination of such suspension shall be promptly notified in advance to the other Contracting Party through diplomatic channels.

Article 8

1. For the purpose of implementation of this Agreement, the Contracting Parties shall exchange through diplomatic channels, not later than 30 (thirty) days from the date of signing this Agreement, the samples of passports mentioned in this Agreement.

2. The Contracting Parties shall inform each other of an introduction of new passports or modification to existing passports, and shall transmit samples of new or modified passports at least 30 (thirty) days through diplomatic channels prior to their introduction or validity of any modification.

Article 9

By mutual consent of the Contracting Parties, amendments being an integral part of this Agreement may be introduced to this Agreement and shall be formalized in separate protocols.

Article 10

1. This Agreement shall enter into force 30 (thirty) days from the date of receipt of the last written notification by which the Contracting Parties notify each other, through diplomatic channels, of the completion of their internal legal procedures required for the entry into force of this Agreement.

2. This Agreement shall thereafter continue to be in force indefinitely until either Contracting Party terminates it by six (6) months prior to written notice given to the other Contracting Party through diplomatic channels.

2. With the entry into force of this Agreement, the Agreement between the Government of the Socialist Republic of Viet Nam and the Government of Mongolia on the conditions of mutual visits of citizens, signed on January 07 2000, shall be repealed.

Signed in Ha Noi on November 01, 2023 in two original copies, each in the Vietnamese, Mongolian and English languages, all texts being equally authentic. In case ol divergences in interpretation, the English text shall prevail.
